Using this website
This website belongs to Trillium Pastry, a small business in Ontario, Canada (“we”, “us”). By using it or sending us an order request, you agree to these terms and to our privacy policy. If you don't agree, please don't use the site.
Topper safety
Please read this before you use your topper.
- Toppers are decorations, not food. Unless we have told you in writing that a part is edible, don't eat any part of it. Remove the topper from the cake before cutting and serving.
- Not a toy. Toppers can have small parts, sticks, picks or wires and are a choking hazard. Keep them away from children under 3, and don't leave young children alone with one.
- If you or your guests have allergies, ask us what materials your topper is made of before you order. Toppers may touch the cake, so keep this in mind when serving.
- Keep toppers dry and away from heat and direct sun. Don't put them in the microwave, oven or dishwasher.
- We make toppers only. The cake, and what goes into it, is the responsibility of whoever bakes it.
Orders
- The order form sends a request, not a purchase. Nothing is paid through this website. We reply to talk through the design, price, any deposit, timing and pickup or delivery.
- Your order is confirmed only once we have both agreed to those details in writing (by email or message) and any deposit we asked for has been paid. That written confirmation, together with these terms, is our agreement.
- We may decline any request, for example when we can't make it well in the time available. Short-notice orders may not be possible.
- Prices are only those we confirm to you in writing; nothing on this website is an offer at a fixed price.
Your design requests
When you send us names, photos, logos, artwork or other material to copy, you confirm that you have the right to use it and that making it into a topper for you is allowed. We may decline designs that use other people's trademarks or characters (such as sports teams, brands or cartoon characters), and anything offensive or unlawful.
Handmade means one of a kind
Every topper is made by hand, so small differences in shade, size and finish from photos on this site, on Instagram or in a mock-up are normal and are not a defect. Colours also look different on different screens. Photos on this website show toppers we have made before, as examples of our work.
Changes, cancellations and refunds
Because each topper is made to order, the rules for changes, cancellations, deposits and refunds are the ones set out in your written order confirmation. If something is wrong with your topper when you receive it, please contact us as soon as possible (ideally within 48 hours) with photos, and we'll work with you to put it right.
Nothing in these terms takes away the rights you have as a consumer under Ontario's Consumer Protection Act, 2002 or any other law that can't be changed by agreement.
Our photos and designs
The photos, designs, text and logo on this website belong to Trillium Pastry and are protected by copyright. You're welcome to share links to this site and to share our Instagram posts using Instagram's own sharing features. Please don't copy, download to reuse, sell or edit our photos or designs, or present them as your own work, without our written permission.
Fair use of the site
Please don't misuse the site: no false or abusive order requests, spam, attempts to break or overload the site, or collecting information from it with automated tools.
Links to other sites
This site links to Instagram and other services we don't control. Their own terms and privacy policies apply there, and we're not responsible for their content.
The website itself
We try to keep this website accurate and working, but it's provided “as is”. We may change, update or remove any part of it at any time, and we can't promise it will always be available or free of mistakes.
Our responsibility to you
As far as the law allows, we're not responsible for losses that come from using this website, or for indirect losses (such as a missed event or lost profits) from a topper, and our total responsibility for any order is limited to the amount you paid for it. This doesn't limit our responsibility where the law doesn't allow it to be limited, including your consumer rights and our responsibility for injury caused by our negligence.
Which law applies
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be dealt with by the courts of Ontario, unless consumer law gives you the right to go elsewhere.
Changes to these terms
We may update these terms from time to time; the date at the top shows when they last changed. The terms that apply to an order are the ones in place when we confirmed it.
